Terms & Conditions

1. Agreement to Terms

These Terms and Conditions (“Terms”) are a binding agreement between you and Authentic Craft, LLC (“Authentic Craft,” “we,” “us,” or “our”). These Terms govern your access and use of our websites and applications (including authenticcraftentertainment.com, consulting.authenticcraftentertainment.com, and InTheMix), participation in events, and any other services we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms from time to time. The most current version will be posted on our websites, and the effective date above will be updated. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility & Account Registration

You must be at least 18 years old (or 13 with parental consent) to use the Services. By using the Services, you represent that you have the legal capacity to agree to these Terms. You agree to provide accurate and complete information when creating an account and to keep your account credentials confidential. You are responsible for all activities that occur under your account.

3. Description of Services

Authentic Craft provides entertainment and hospitality solutions, including (i) marketing information about our events, music releases and consulting services, (ii) the InTheMix platform that allows users to discover DJs, request songs, explore events, and interact with the community, and (iii) consulting and event production services for third parties. Additional terms may apply to certain Services; if you participate, those additional terms become part of these Terms.

 

4. User Conduct

You agree not to:

  • Use the Services for unlawful, fraudulent, or harmful purposes.

  • Upload or transmit content that is illegal, abusive, harassing, defamatory, obscene, or infringes another’s rights.

  • Access the Services in a manner that could damage, disable, overburden, or impair our servers or interfere with any other party’s use.

  • Attempt to gain unauthorized access to any portion of the Services or any related systems or networks.

  • Use bots, scrapers, or other automated means to collect information from the Services without our express permission.

5. User‑Generated Content

Certain features allow you to post, submit or share content (such as song requests, comments, reviews, or messages) (“User Content”). You retain ownership of your User Content, but you grant Authentic Craft a perpetual, worldwide, royalty‑free, irrevocable, non‑exclusive license to use, copy, modify, adapt, distribute, publicly display, perform and otherwise exploit your User Content in connection with providing and promoting the Services, including in marketing materials. You represent that you have all necessary rights to provide your User Content and that it does not infringe any third‑party rights. We reserve the right (but are not obligated) to remove or restrict User Content that violates these Terms.

6. Intellectual Property

All content on the Services—including text, graphics, logos, images, audio clips, video, software and data compilations—is the property of Authentic Craft or its licensors and is protected by copyright, trademark and other laws. You may not modify, reproduce, distribute, create derivative works from, or exploit any content except as expressly permitted by these Terms. All trademarks, service marks and trade names are proprietary to Authentic Craft or our partners and may not be used without prior written permission.

7. Purchases and Payments

Some Services may require payment (such as event tickets, subscription fees or merchandise). When you make a purchase, you agree to provide accurate payment information and authorize us and our payment processors to charge the applicable amount. Prices and availability are subject to change. Except as required by law or as stated for a particular event, payments are non‑refundable.

8. Event Terms & Conditions

Sections 8.1 through 8.9 apply when you attend or participate in any Authentic Craft event (including live performances, workshops, community gatherings, or virtual events). These terms incorporate industry best practices and a general attendee waiver:

8.1 Admission & Conduct

You must comply with all venue policies, local laws and instructions from event staff. We reserve the right to refuse entry or remove individuals for disruptive, unsafe, or inappropriate behaviour without refund.

8.2 Tickets & Entry

Tickets are non‑refundable unless expressly stated otherwise. Entry may require proof of purchase, identification and compliance with any health and safety protocols. Re‑entry is at the venue’s discretion. Tickets may not be resold or transferred in violation of applicable laws.

8.3 Assumption of Risk and Waiver

Attendance at events involves inherent risks, including personal injury, illness (e.g., exposure to communicable diseases) or property loss. By attending, you voluntarily assume all such risks and accept sole responsibility for any injury, loss, claim or expense that may arise. To the fullest extent permitted by law, you release and hold harmless Authentic Craft, its officers, employees and agents from any claims or liabilities related to your attendance. This waiver extends to claims arising from the acts, omissions or negligence of Authentic Craft or its representatives.

California Civil Code § 1542 Waiver. California law provides that a general release does not extend to claims that the releasing party does not know or suspect to exist at the time of executing the release, which, if known, would have materially affected the settlement. By attending an Authentic Craft event and agreeing to this waiver, you expressly waive and relinquish the protections of California Civil Code § 1542 and agree that the release herein applies to all claims, whether known or unknown, that arise out of or relate to the event. You acknowledge that this waiver of section 1542 is an essential and material term of this agreement.

8.4 Media & Recording

Events may be photographed, filmed, or recorded. By attending, you grant Authentic Craft and its partners the right to use, reproduce, publish, adapt and transmit your name, image, voice and likeness in any medium for promotional and marketing purposes without compensation. We will make reasonable efforts to accommodate attendees who request not to be photographed or recorded; please notify us before the event.

8.5 Opt‑Out Requests and Privacy

If you prefer not to appear in event media, notify a staff member or contact us after the event. Our Privacy Policy applies to data collected at events. By attending, you agree that we may collect and use your contact information for marketing, event administration and research, and that we may share limited attendee lists with service providers and sponsors.

8.6 Event Changes

We reserve the right to change event details (including lineup, schedule or venue) or postpone or cancel events due to unforeseen circumstances. In such cases, our liability is limited to the refund of the ticket price (if applicable).

8.7 Optional Activities

Some events may include optional activities that carry additional risks (e.g., physical challenges). Participation is voluntary and may require you to sign an additional release. By participating, you assume all risks and agree to release and indemnify Authentic Craft and our affiliates from any claims arising from those activities.

8.8 Code of Conduct and Non‑Discrimination

Authentic Craft is committed to providing a harassment‑free environment and does not discriminate on the basis of race, colour, religion, national origin, sex, age, disability or any other protected status. We expect all attendees to behave respectfully and comply with our Code of Conduct. We reserve the right to remove anyone who violates our policies without refund.

8.9 Disclaimer

Event content, including statements by performers, speakers or participants, is provided “as is” without warranties of any kind. Authentic Craft does not guarantee that event content will meet your expectations.

9. Third‑Party Services and Links

The Services may contain links to third‑party websites or services that are not owned or controlled by Authentic Craft. We are not responsible for the content, policies or practices of these third parties. Your interactions with third‑party sites are governed by their own terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. You may terminate your account by contacting us. Upon termination, rights granted to you under these Terms will cease.

11. Indemnification

You agree to indemnify and hold harmless Authentic Craft, its affiliates and their respective directors, officers, employees, contractors and agents from any claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of another.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied. Authentic Craft disclaims all warranties, including merchantability, fitness for a particular purpose and non‑infringement. We do not guarantee that the Services will be uninterrupted or error‑free.

To the maximum extent permitted by law, Authentic Craft and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages arising from or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Services will not exceed the amount you paid us (if any) in the twelve months prior to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations; in such cases, these exclusions may not apply to you.

13. Dispute Resolution and Governing Law

These Terms and any disputes arising out of or relating to them or the Services are governed by the laws of the State of California without regard to conflict‑of‑law principles. You and Authentic Craft agree to submit any disputes to binding arbitration on an individual basis pursuant to the Federal Arbitration Act. Class actions and class arbitrations are not permitted. The arbitration will be conducted by a single neutral arbitrator in San Jose, California. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in court to prevent the unauthorized use or abuse of intellectual property or confidential information.

14. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and Authentic Craft regarding the Services and supersede any prior agreements or understandings. Our failure to enforce any right under these Terms is not a waiver of such right. You may not assign these Terms without our prior written consent; we may assign our rights and obligations without restriction.
